Tripartite Internship Agreement

If it is a master`s degree in a company, the student must enter it in the „Masterprojekt“ tab and not in the „Stages“ tab, even if the possibility has been found via the list of internships on ISA. If the internship contract is not an employment contract, but an internship allowance, the internship contract is qualified as a fictitious employment relationship (tax and social security). This means that the intern who receives an internship allowance must be included in the payslip, in this case, the company must also deduct income tax, national insurance contributions and employer contributions from the internship allowance under the Health Insurance Act2. However, there can be no question of an internship allowance in this context if the assistance covers only reasonable and real costs, such as travel expenses. B.3 To approve the internship contract, students must pass the internship to the internship coordinator after the signing of the internship coordinator, in accordance with the certification agreement of the internship coordinator. The internship coordinator reviews and approves the agreement in agreement with the teacher. The internship contract will be refunded to the student as soon as all the necessary signatures have been collected. After selecting an internship, students must enter into an employment contract with the company and jointly enter into an internship contract. These agreements apply only to current and fully registered students. Students who leave for an internship abroad must apply to the EPFL`s Safety, Prevention and Health (DSPS) website to benefit from the emergency assistance programme. This program provides additional assistance if necessary, but does not replace the personal insurance policies, as described above, that the student must maintain for the duration of his internship.

In order to ensure good management in relation to the academic process, the student must record information about his internship or his master`s project on ISA (the school`s academic registration platform). A new requirement is that all students applying for an internship contract must also submit a completed and signed student-signed risk assessment form when submitting their signature for signature. No agreement is signed in the absence of a risk assessment form. The internship contract is not specifically regulated by law. The parties are therefore in principle free to agree on the conditions under which the internship contract is concluded. Because of the three essential elements of an employment contract, an internship contract could indeed be an employment contract. Compulsory internships for engineering students are covered by a tripartite agreement. Once the student has found an internship, he must have an agreement signed by the three parties concerned (society, school, students) and provide an original copy to each signatory. Very rarely, a company can refuse to sign the internship contract. It is then necessary for the student to contact his department internship coordinator to explain why the company does not wish to sign the document. Possible solutions will then be discussed between EPFL and the company. The signing of the EPFL tripartite agreement does not impede the establishment of a separate bilateral contract between the company and the student.
